With the popularization and vigorous development of Internet,people's life style has been changed.However,the integration of Internet economy and technology not only brings unparalleled vitality to competition and innovation,but also breaks many industry practices and legal rules in the past.In order to gain more market share,operators want to obtain improper interests by means of unfair competition,which seriously affects the normal competition order of the Internet market.The anti unfair competition law,which was officially promulgated and implemented on January 1,2018,adds new Internet terms in Article 12,which is conducive to regulating the order of Internet competition behavior.However,with the rapid development of Internet technology,there are still many problems in the legal regulation of Internet unfair competition.This paper is divided into six parts,the main contents are as follows:The first part: introduction.Through a brief description of the background,purpose and significance of the topic,this paper analyzes the research situation at home and abroad,and briefly introduces the main contents of the paper.The second part: an overview of Internet unfair competition.By combing the academic views on the concept of unfair competition behavior,combined with Internet technology,this paper defines the unfair competition behavior of Internet from the perspective of law.In addition,combined with the reality,this paper analyzes the characteristics of the current Internet unfair competition behavior.The third part: the current situation of Internet unfair competition in China.This paper analyzes the provisions of the Internet unfair competition provisions in the anti unfair competition law,the formulation of relevant administrative regulations and departmental rules,and the self-discipline norms of the Internet industry,and summarizes that the current legislation is not perfect and comprehensive.The fourth part: the legal regulation of Internet unfair competition in foreign countries,such as Germany and the United States.On the basis of fully considering the actual situation of our country,we should learn from the experience and practice which are beneficial to the Internet unfair competition in our country,such as the system of pre litigation injunction.The fifth part: combined with the legislation and actual situation of the Internet unfair competition in China,analyzes the problems faced by the Internet unfair competition in China.For example,the specific provisions of unfair competition on the Internet are not comprehensive,and the judicial remedies are not complete.The sixth part: suggestions on improving the legal regulation of Internet unfair competition in China.Corresponding to the fifth part,it puts forward specific suggestions,including the appropriate increase of specific provisions of unfair competition on the Internet,the improvement of pre litigation injunction system and so on.
