| The coming of the Internet Era has changed the way society operates and the way people live.The combination of the Internet economy and technology provides a new model and convenience for social operations and people’s lives.However,while bringing vitality to society’s efficient operation and the innovation of people’s orderly life,it also intensifies competition.Competition in the Internet Era also breaks through the past mode and has innovation and development.In 2017 and 2019,the Anti-Unfair Competition Law was revised once and amended once respectively,aiming to keep up with the times’ pace and make more effective regulations in the face of endless new unfair competition in the Internet Era.The Anti-Unfair Competition Law,officially promulgated and implemented on January 1,2018,added an "Internet clause" to Article 12 of the Law,aiming to regulate Internet competition behavior and form a good order that benefits the society,the market,business operators,and consumers.However,the Internet industry’s technology and the operation mode are constantly changing,leading to the legal regulation of unfair competition behavior.There are still many problems worth studying and discussing.At present,China’s regulations for unfair competition behavior in the Internet field are still insufficient.The legal regulations that bear the responsibility of regulation are very prominent,reflected in legislation,law enforcement,and multiple judicial levels.To some extent,with the revision of the Anti-Unfair Competition Law,the "Internet Clause" in Article 12 has been made up for the lack of legal provisions on the Internet’s anti-unfair field in the legislation.Still,there are considerable difficulties in practice,and the problem of incomplete related supporting theories and explanations has not been solved.Other issues,such as the regulation of unfair Internet competition by many laws,the lack of relevant theory and guidance at the law enforcement level,and the inconsistency of judicial adjudication theory and thinking,also affect the effective regulation of unfair Internet competition behavior.This paper hopes to understand the nature of unfair competition in the Internet field,and then explore some theories and practices about unfair competition in the Internet field in today’s world.Combined with the actual situation in China,to explore whether overall planning of laws and regulations,the establishment of specialized law enforcement agencies,and clear adjudication methods can solve the unfair competition behaviors in the Internet field.Of course,due to the limited knowledge level,my opinions on some issues may be shallow and omissions,but I still hope that my research results can contribute to the legal regulation of China’s anti-unfair competition,especially the unfair competition behavior on the Internet. |
