Natural monopolies are initially unable to compete or not suitable for the formation of monopoly competition, later it is considered from the scale of the economic point of view that, natural monopoly means a business at less than the cost of two or more companies to the market due to resource distribution conditions supply of particular goods or services arising from the monopoly. For a long time, the power industry implement the monopoly with natural monopoly characteristics. The monopoly is the antithesis of competition, competition promoting progress and the monopoly protecting backward. In this sense, any monopoly should be opposed and broken. Related to all the industrial and agricultural production, electricity is the basic industries in our country. The basic characteristics of China’s current monopoly come with economies in transition, attempting to resolve the issue of monopoly by a single means (such as legal means) is impossible. Only the comprehensive use of economic, legal, administrative and reform means, can gradually solve the problem of monopoly power industry in our country.The paper is divided into five parts, on the electricity industry monopoly legal rules and regulations question to carry on the system analysis and research, and put forward some suggestions to make a number of sound recommendations. The first chapter introduces the research background, the object of study, research significance, and the main content in this article as well as the research methods. The second chapter is the basic theory of the monopoly of legal regulation in the power industry, mainly the analysis of power industry characteristics, as well as the basic theory of natural monopoly. The third chapter is to analyze the current situation and existing problems of the monopoly of legal regulation in the electric power industry, focusing on the status of the monopoly of China’s power industry, the status of the law of its regulation, and some shortcomings. Followed by the fourth chapter is the legal regulation of the monopoly of foreign power industry and its reference significance, showing the foreign electricity reform and legal regulation, mainly citing the experience of the UK, USA and Australia, three countries, but also summed up the foreign What are the implications on the regulation of the monopolistic behavior of the power industry to China. The last part is the most important part, through the discourse of the previous parts, which puts forward specific recommendations for improving the legal regulation of the monopoly of China’s electric power industry.
