Research On Justice Basic Of China Socialist Rule Of Law

"What is the socialist rule of law? How to build a socialist country under the ruleof law?" Two basic problems are the fundamental starting points for this study. It isdiscovered through basic research on the rule of law that the rule of law and justiceare closely linked. The direct value of the rule of law is the formation of social andlegal order good for social production and life. Direct purpose of our country buildinga socialist country ruled by law is to establish a socialist legal order. In addition to thefunctions of order value, the most fundamental purpose of the rule of law is to achievesocial justice values. Depending on the social system established by the rule of law,the rule of law can be divided into a socialist rule of law and a capitalist rule of law.The legal order of rule of law under different social systems is the same, but socialjustice pursued under the stable order is totally different. China’s socialist rule of lawis established on the basis of the socialist system, the rule of law in the pursuit ofjustice is the justice of the socialist society, unlike the justice of the Western capitalistcountries. Therefore, we hope to explore the principles of social justice to be pursuedby the socialist rule of law through basic research on the socialist rule of law andjustice. The article is mainly argument from the three dimensions of social, personaland institutional justice basic of the socialist rule of law. The preamble of the articlebriefly discusses the causes and background of the “socialist rule of law and justicebased”. Article body part is divided into three chapters. The first chapter is aboutprinciples of justice of the socialist society, which include the principles of safety,freedom and equality. The socialist principle of justice is the orientation of the overallvalue of China socialist legal construction. The second chapter talks about the justiceof authority of the country under the rule of law. Justice of authority of the countryprovides the value of standards and principles to ensure the power of authority run inthe right way. The second chapter is divided into three subsections including justice ofadministrative agencies, legislative bodies and judicial institutions. The third chapteris the problem of individual justice in a society ruled by law. The personal justiceunder the rule of law is the practice of law.
