On Special Ivestigation Of Organized Crime

Organized crime is a kind of criminal pattern with serious social harmfulness. The harmfulness comes from Organized crime’s behavior in the nature of violent and cruel, its permeability to areas of politics and economic.In China, the criminal law in1997provides for crime of organization in the nature of criminal syndicate. Crime of organization in the nature of criminal syndicate has been recognized as the most typical organized crime.It is a particular legal concept in China. The organized crime cases have many characteristics such as large members of committing a crime, many times of illegel crime,many accusations offended,longtime-span,widely regional coverage of committing a crime,complexity of the social relationships and much workload of detection.When the public security organs investigate and prosecute these cases,they usually have difficulty in finding the clue, in investigating and getting the evidences,in pursuing and capturing an escaped criminal,in censoring and interrogating the suspectors,or in applying the law. Therefore,it is an important topic for the leadership of public security organs at all levels, for every leader and every member of the public security organs to research investigation of special cases of the organized crime.The article first analyzed the current situations and characteristics of the organized crimes in our country, then explored the legal features of organized crimes, probed the working principles and methods of special investigation of organized crime.The article was divided into three chapters. Chapters1introduced the concept of the organized crime and crime of organization in the nature of criminal syndicate, researched the basic characteristics of organization in the nature of criminal syndicate and analyzed the situations of organization structure, organizational scale, economic strength and crime method of organization in the nature of criminal syndicate from social field,economic field, political field and combating level four different angles. Chapters2, based on the above characteristics,discussed the principles and methods of special investigation of crime of organization in the nature of criminal syndicate. Chapters3discussed how to conduct a special investigation of crime of organization in the nature of criminal syndicate from forming investigators’s group,heightening the group’s discipline,finding clues,carrying out investigation and obtaining evidence, tracking down and arresting the escaped criminal,methods of investigation,winding up a case,making the indictment.
