Research On The Investigation Mechanism Of Underworld Organization Cases Under The Background Of A Special Crackdown Against Organized Crimes

China has been cracking down on organized crime in recent years.Meanwhile,organized crime has been changing and upgrading continuously in order to avoid being investigated.Overall,the organized crime situation is still grim,and vicious power,acts as reserve forces of organized crime,remains active,the form of criminal organization has begun to corporatized;ways of obtaining profits has become pluralistic;among all the means of crime,the "soft violence" has taken up large presence;the corruption to grass-roots organs has increased;computer crime has become a new trend.In conclusion,serious criminal situation brings new challenges to the public security organization.The criminal situation is getting more and more serious,while there are many difficulties in the process of fighting against organized crime,such as,covert criminal clues with single collecting channels and low receiving quality;collecting evidence with a great work load because of enormous system;complicated fact-finding of cases and disagreements on the standard of evidence between judicial authorities;fighting against the covert protectors and demarcating or handling illegal property of criminal organization;lack of professional team,poor protection of police,and so on.Obviously,to solve these problems,more effective investigation measures,especially institutionalized resource configuration and personnel assignment,are needed.In early 2018,the CPC Central Committee and the State Council declared that we would launch a three-year campaign to crack down on organized crime,aiming at to eliminate the crime forces with stronger efforts and purifying the social environment.The campaign provided the system guarantee for the investigation work,especially for the improvement of the investigation mechanism from the aspects of political force,legal policy and case handling resources.For the purpose of improving the capacity and level of combating and preventing organized crime,the public security organization should seize this opportunity and take various measures summarized from investigation practice.They can try to commence from the following aspects,improving the professional investigation team safeguard mechanism by building professional teams,supporting more funding and equipment,safeguarding rights and interests of the anti-crime police,etc;improving the intelligence-led investigation mechanism by strengthening the examination of clue detection,intelligence research,judgment and early warning,etc;improving exemplary cases guarantee mechanism by drafting police elsewhere in charge of cases,supervising the handling of major cases,technical detection synchronous;improving administrative unit corporation mechanism by keeping the channel for corporation clear,assisting cases investigation,notifying and feeding back clues with each other,especially strengthening corporation with supervisory departments,procuratorial department,and civil affairs departments;improving criminal wealth survey mechanism and criminal members manhunt mechanism.
