On Improving The Mechanism Of Multiple Solutions To Civil Disputes

In recent years, conflicts of people have been increasing with the advancing economy and society. Thus, the mechanism of multiple solutions to civil disputes becomes significant in modern society. The mechanism of multiple solutions to civil disputes means that various solutions to disputes, which perform specific functions, co-exist and develop in harmony to constitute the dispute-solution mechanism for meeting the multiple demands of social members. This mechanism is not only helpful to solve the disputes of parties, lessen the confrontation between parties, and decrease the litigation cost for parties, but also beneficiary to saving the judicial resources of the state and constructing the harmonious socialist society. However, the mechanism of multiple solutions to disputes needs improvement because of its deficiencies in both theory and judicial practice. The thesis begins with the present situation of the mechanism’s operation in China, makes a comparative study of the mechanism of multiple solutions to civil disputes in the countries of the two legal families, and suggests on setting up the coordinated mechanism to improve the mechanism of multiple solutions to civil disputes in China.
