The Research On The Legislative Protection Of The Criminal’s Health Rights

As an important part of human rights, the health right is the most basic right of citizens and the foundation of other rights. Prisoners, whose personal freedom is temporarily limited, are citizens too, but their health rights and other basic rights are still under the protection of the constitution and laws. However, in practice, because of the imperfection, the legislation and other factors, the protection of the criminal’s health rights still have many problems and get further space to be discussed. This paper starts with the legislative protection of the criminal’s health rights. Firstly, the paper introduces the connotation of the criminal’s health rights, and analyses the necessity of strengthening the protection of the criminal’s health rights. Secondly, this paper summarizes the present situation of the legislative protection of the criminal’s health rights, and analyses the main problems of the legislation. Finally, combined with the present situation and problems of the legislative protection of the criminal’s health rights, the paper puts forward the suggestions to perfecting the legislative protection of the criminal’s health rights.
