The Leagl Issues Study On Agricultural Ecotourism

These years, the agricultural ecotourism has become the leading edge topic and the hot issue of tourism. Agricultural ecotourism has been more and more popular,that is the opportunity for economic development, but this is also a severe challenge,for the capacity of the ecological environment,how to protect the environment and natural resources, protect farmers’ environmental rights is an important issue.This paper foucused on peasants’ environmental rights, through the perspective of farmers ’environmental rights protection to draw the attention of the society to it.First, this paper taken the law as the main perspective, and other perspective, such as economics, make research on the theory of agricultural eco-tourism based on the protection of farmers’ environmental rights. In Law aspects, there are the theory of environmental rights and,the peasants’ environmental rights theory, in economic aspects, there are externality theory and public property theory. In order to provided a theoretical basis for the protection of agricultural eco-tourism based on farmers’ environmental rights.Second, we did in-depth analysis of the environmental protection of ecotourism of United States, Japan, Australia and other countries, in order to learn some experiences for farmers’ environmental protection of agricultural ecotourism in China. To the conclusion that:a complete legal system is an important guarantee of the agricultural ecotourism development, government is the leading force of the agricultural ecotourism development, community participation is an effective way of agricultural ecotourism development, environmental education is the necessary measures for agricultural ecotourism development, the peasants’ environmental rights protection is an important goal of agricultural eco-tourism development.Third, take the basic considerations of the situation of China’s agricultural ecotourism development and environmental protection, in-depth investigation and analysis of the status of China’s agricultural ecotourism development and problems of ecotourism, we find that agricultural ecotourism legal system is imperfect, running protection mechanism is not excellent.Finally, based on the overall environment of the ecotourism development in China, we drawing on the experiences and measures of relevant countries,then we should establish and improve the main certification system,the environmental regulatory system,ecological compensation system,community participation system and protection mechanism,in order to guide the agricultural ecotourism developes well, provide legal support for the development of agricultural ecotourism, to achieve the unity of the environmental, economic, and social benefits.
