The Research On The Legal Standardization Of The Enforcement By The Border Inspection Authorities Of China

Under the background of the comprehensively deepening reform,the CPC central committee and the state council put forward the requirements of deepening the standardization of public security administrative law enforcement further.The Exit/entry border inspection authorities,which is part of the ministry of public security,must surround the requirement of rigid,civilized and just law enforcement and deepening the standardization of administrative law enforcement further.While,the object of the standardization of administrative law enforcement is the same as the value of administrative law.The basic principal of administrative law,which embodies the internal connections and the basic spirit among the numerous regulations of administrative law,puts forward the comprehensive requirements of the enforcement by the border authorities.So whether the enforcement by the border authorities is standard or not,is essentially judged by the basic principles.This article first analyzed the relationship between the two conceptions,then listed the differences in nature and characteristics between the border authorities and the others,summarized out some situations of conflicts with the basic principles,and then performed the causal analysis of it and proposed actions in the aspects of legislation,enforcement and legal remedy for the sake of the legal standardization.From the above,how to influence the formulation of Exit/entry law from the point of the basic principles,how to make sure the enforcement by the border authorities be strictly observed by laws,and how to wield the power of Exit/entry inspection normatively and ensure the right of persons who will exit and enter the border,are the key to the legal standardization construction that the border authorities should deeply concern.
