Trade union law of the People’s Republic of China: Article18a trade union mayrepresent workers in signing a collective contract with an enterprise or publicinstitution’s administrative authority. The draft of a collective contract shall besubmitted to a meeting of employee representatives or the complete body of employeesfor discussion an adoption. According to above law, in collective bargaining andcollective contract signing process, the union leader is always a positive, but union andnot the collective contract party, just as employees, as one party, legal representative,represent workers participate in collective to negotiate and sign a collectivecontract.However, in the collective bargaining process and the signing of collectivecontracts, the union is the first place. The union negotiation skills that is greatlyinfluence the whole process until the final result.In China collectiveconsultation and the collective contract system has been in the implementation ofthe decade.The labor department established collective contract provisions in1994.12,The all-china federation of trade unions passed the union to equal consultationsand conclude collective contracts try out method in1995.8.The provisions of theenterprise unions and superior union participate in equal consultations and the role ofthe sign a collective contract. Enterprise with enterprises to establish trade union shallequal consultation system, involving regularly or irregularly lawful rights and interestsof its workers issues such as equal consultation; Enterprise a trade union shall on behalfof the worker sign a collective contract with the enterprise; Enterprise labor union shallregularly organize relevant personnel to the collective contract performance, superviseand inspect the problems found with enterprise in time after negotiation. The tradeunion at a higher level of enterprise trade unions and enterprises shall be of equalconsultation and sign a collective contract work for help. guidance and the supervisionand inspection.After more than ten years, the implementation of the collective contract system inour country enterprise unit especially in state-owned enterprises has preliminarilyestablished, unions in which also played an important role.However, the collective contract system in our countrythere are also many problems, mainly displays in Collective contract signed innon-state-owned enterprises; rate very low Specialized collective contract especiallysalary collective contract although push strength is very big, but needs to be improved;sign rate Regional industry collective contract still need to further strengthen implementdynamics; Collective contract should also further enrich the content, the collectivecontract effectiveness still need to further strengthen, etc.To solve these problems, it isnecessary to exert the function of union.Therefore, in the whole nation is in actively promote salary collective talks thingsover in the backdrop, studies how to give full play to trade unions in promoting thecollective contract system shows the role has theoretical significance and pressing thepractical significance. This paper tries to further develop union function, mining unionspotential, promote the collective contract system in our country’s widespreadpopularization and in-depth implementation, for establishing harmonious labor relationsand building a harmonious society as some useful exploration.
