Public Law Regulation Theory Of Drunk Driving Behavior

With the increasing living standard, car ownership is also increasing, plus our country has a long history in wine culture, therefore, the phenomenon of drunk driving is more serious. In recent years,"drunk driving" has become the focus of attention in society and the topic people talk about when they are not busy. Sun Weiming of Si Chuan Case and Li Jingquan of Fo Shan Case lead to all sorts of drunk driving tragedy even more shocking. It also causes widespread concern in society and people’s deep reflection on "drunk driving". Alcohol can reduce driver’s receiving and perception of message and their ability to operate, can prolong their reaction time. Finally, all the these cause they have a very bad self-control and directional obstruct. Drunken driving victims and their families not only caused great harm, is more serious is that such behavior on people’s travel safety and the community have caused a huge public safety hazard.With Criminal Law Amendment Eight cause drunk driving become a crime, the Law of Traffic Safety has adjusted suitably. It also leads the topic "drunk driving"’to a new climax. By researching existed law about drunk driving in this paper, and study the control methods of drunk driving in other countries, then find the weakness of existed law and law enforcement in our country. At last in this paper, put forward some suggestions on how to consummate legal regulation of drunk driving. This article is divided into five parts. The first part is analysis of law quality of drunk driving, only do understand the law quality of drunk driving, better suggestions on control this phenomenon will put forward, pave the way for later. The second part talk about current situation and weakness of existed criminal law in point of view of legislation and enforcement. The third part talk about current situation and weakness of existed administration in point of view of legislation and enforcement. The forth part, by analyzing legal regulation of drunk driving in other countries, compare with our existed law, absorb the part that we deserve study. The fifth part put forward some suggestions on consummate legal regulation of drunk driving.
