August23rd,2010, The11Standing Committee of the National People’s Congress sixteenth conference deliberated the amendment of the Criminal Law of the People’s Republic of China (8)(draft). The draft takes drunk driving, race driving causes serious accidents as crime. The Criminal Law of the People’s Republic of China (8) was put into implementation since May1st,2011and drunk driver will be investigated for criminal responsibility for danger driving. This has been paid high attention before and after the law implemented.Drunk driving has been a serious problem in China for a long time. The pervasive dangerous behavior is largely related to our custom. Wine culture has a long history in our country and since Reform and Opening up people’s living standard has been raised a lot, wine poured into people’s life, becoming a necessity in holidays and daily social contacts. Besides, with the rapid development of economy the number of motor vehicle drivers is also rapidly increasing, thus causing more and more accidents happen. Drunk driving is the source of traffic accidents, especially serious accidents. It threats public safety and also citizens’lives and property.At the same time we must realize that drunk driving is a kind of complicated and solid-rooted social disease and can’t be deleted by the implement of the law. I think we should take Japan’s "Casualties Crime Caused by Dangerous Driving" as reference and at the same time adjust relevant rules of administrative law, enforce the related laws, improve propaganda work about traffic safety, and take an appropriate reference to some flexible policies in other countries. Only by multilevel and multi-means comprehensive management may the drunk driving problem could be totally solved.
