| With the trend of large-scale and collectivized enterprise in current global economy,small and medium-sized enterprises (SMEs) are still dynamic which is called “mostdynamic economic cells†by economists. SMEs are occupying the majority of entity in nomatter developed or developing countries. The well development of SMEs is beneficial innot only promoting sustainable economic increase, stabilizing export, increasing taxrevenues and expanding the domestic demands; but also in favor of striving of fullemployment, fair distribution and harmonious society. SMEs, one of the foundations ofachieving new economic development and the crucial component of Chinese economy, areimportant pillars in the growth of economy and also major ways to release the employmentpressure.How to promote the development of SMEs has been emphasized by countries from astrategic point of view. It is generally agreed among international community of economicsand academy that SMEs will play the leading role in economic development of the21scentury. As the large-scale enterprise emerging from growth of economy, its tremendouseconomic forces cause the generation of special rights in business, which Breaks theequality between the market entity. SMEs, however, are in a week position in marketingcompetition due to several marketing pressures such as shortage of talent resources andcapitals, lack of market access and information acquisition, monopoly from large-scaleenterprise and unfair competition between SMEs. Only can SMEs be protected by remedyprovisions to achieve the fairness in business transaction. It is the first step to create a goodmoral circumstance of market economy for SMEs to compete with large-scale enterprisefrom applying laws and regulations which are beneficial to SMEs. In developed countries,SMEs will be protected by Competition Act and such law and regulation to ensure the wellprogress of market economy. In China, SMEs are protected under laws and regulations suchas SMEs Promotion Statute of the People Republic of China and Antitrust Act in order tomaintain the market order, curb monopolization and provide exemption regime.Nevertheless, problems still exist regarding Chinese government providing legalprotection for SMEs comparing other developed countries. We should obtain experiencefrom countries and groups like EU, USA, Germany and Japan which are in the forwardposition in the world concerning protection SMEs and combine with the situation of our country to consummate our SMEs’ legal protection system and ensure comprehensive,balanced and sustainable economic and social development of SMEs. |
