The Research On Auction Fraud Legal Regulation

Auction fraud refers to the auction parties fabricate fictional facts or conceal the truth during the auction in order to make the relative sides of the auction to express their intentions falsely. Auction fraud is a concrete manifestation of fraud problem in the auction industry. If we can not solve this problem in time, the auction fraud will infringe the legitimate rights of the auction parties, hinder the healthy development of China’s auction industry and even break down the competitive order of socialist market economy. According to current situation, legislation and legislative problems of auction fraud problem, the author put forward the method to regulate auction fraud from the aspect of value to specific standard. In the value pursuit of the auction fraud, the article discusses the value pursuit of economics and law base on the value of auction fraud regulation system, then point out value pursuit of auction fraud regulation in our country. In addition, the paper selects the essence, and defines the auction fraud comprehensively and scientifically, analysis the features of auction fraud, summarize the traditional art forms and unique form of auction fraud in our country,declare the scientific classification method of auction fraud in China. In the auction fraud regulation system,the article takes its essence, goes to its dregs, compares the fraud behavior cognizance and relief measures constitute reasonable components to use for reference, makes up a theoretical basis for consummates cognizance and relief system in our country. Last of all, from authors point of view, we should develop the regulation of auction fraud theory system and set up related mechanisms of auction fraud problem such as internal information exemption system, expert false auction identification and assessment system, bid bond fund special deposit system, auction fraud return mechanism, auction fraud insurance and notarization system and so on. Only in this way, the auction fraud can be controlled and combated in time. In order to combat auction fraud, regulate auction activities, protect national interests, social public interests and the legitimate rights of the auction activities, scientific and rational regulation and specialized mechanism is necessary. This paper combines the current situation and legislative situation on auction fraud, and then proposes some solutions which have important theoretical significance and the practical significance.
