Research On The Legal Regulation Of Food Advertisement In Our Country

Abstract：The broadcast ways of information has become more and more variablealong with high speed development of the world, advertisement as a part of thisdeveloping trend provides lots of convenience for the economic development andpeople’s daily life. However, as the same time of the development of advertisement,series of social problems caused by advertising activities has become more severe.Frequenctly happened food safety incidents recent years once bring illegal foodadvertising to the focus of law academic community. Illegal food advertisement notonly violates consumers’ legal rights, credit of the company and social credibility ofthe media and government, but also deprives other competitors the right to share farecompetition on the market, more importantly, disturbs the order of market-orientedeconomic. Though our current laws and regulations have stipulate princeples forillegal social advertisement, but in both the contents of the regulations and legal orderaspect, it’s hard to solve real existing problems. So, how to effectively regulate foodadvertising becomes vital for our society. This paper did systematic research of theabove problem based on the method of regulation analysis and comparison analysis.The concept of food advertisement and its contrucive factors is first presented, basedon this, the judgement criteira of illegal food adevertisement activity is brieflyintroduced. Follow by is how our country builds law system for food advertisement,mainly analysis the default and weakness of current law and regulation system, inorder to to introduce some suggestions of how to optimize our country’s laws andregulations for food advertisement.
