On The Perfection Of Labor Dispatching System

Chinese labor dispatching system develops rapidly in a short time, especially after the implementing of Labor Contract; after the national legislation regulating the labor dispatching system, which causes the labor dispatching increasing instead of decreasing, lead to educational circles and practice area begin to reflect. We shall be obliged to admit the fact that Labor Contract creates the prosperity of dispatching system by strictly protecting the labor relation to some extent. Meanwhile, for some labors’speaking, who have been taken in a disadvantage position in the market that labor force oversupply, the dispatching system at least fixes the labor relation in some degree, which is a method of obtaining employment. Now that the labor dispatching has own values and its negative aspects show the trend of enlarging rapidly, its developmental speed cannot be ignored; law, as the superstructure, also cannot ignore this aspect; law needs to implement some benefit guidance for the purpose of guiding it into healthy direction. The thesis focuses on the reality of labor dispatching system to make some suggestions on the perfection of labor dispatching system under the Labor Contract Law of the People’s Republic of China and Implementing Regulations of the People’s Republic of China Labor Contract Law.Main chapters in the thesis are showed as follows:Fundamental definitions and legal relation of labor dispatching are illustrated in Chapter One. To clarify the differences between labor dispatching and related definitions and correctly to master the differences between labor dispatching and related definitions; to illustrate the relations of three subjects in legal relations for the purpose of establishing theoretical basis for recognizing the labor dispatching system.Chapter Two mainly introduces the development situation of labor dispatching in different countries, as well as provides some experience on labor dispatching. Finally get the advanced experience for Chinese development.In Chapter Three, the thesis mainly analyzes the current situation of Chinese labor dispatching and gets the aspects that need to be regulated by labor dispatching after analyzing the history of labor dispatching, current characters of labor dispatching and its causes.The Chapter Four illustrates Chinese Labor Contract Law and its matching provisions regulate the labor dispatching; moreover, it also concludes the disadvantages on current legislation regulate the labor dispatching after analyzing and assessing.Chapter Five proposes the legislative suggestions on perfecting the labor dispatching system; meanwhile, the thesis also puts forward some revised opinions on labor contract system and social insurance system so that the reasonable operation of labor dispatching system can be well insured.
