With our country’s economic development. The deterioration of ecologicalenvironment is increasingly outstanding,which is already became the yoke of economicand social development. It’s also a threat to human survival. Environmental problem is asocial problem,which needs all sectors of the community work together to provide asolution.But the current administrative management was inadequate, the justice systemis lacking of corresponding remedy mechanism. Environmental public interest cannot geteffective protection, the establishment of China’s environmental public interest litigationsystem is necessary.This article tries to discuss the whole environment public welfare lawsuit and drawlessons from foreign experience by contrast in order to put forward an idea about how tobuild the system of environment public interest litigation based on Chinese condition. Toensure our country’s environmental public interest can get effective protection.Specifically, the first part of this article is about the definition of environment publicinterest litigation.A comprehensive analysis of connotation, features and types ofenvironmental public interest litigation. On this basis, the second part of this article makesa comprehensive review of some countries’ environmental public interest litigation systemwhich is perfect in the current world. Including American environmental citizen suitsystem,the Japanese civil action system, India’s environmental public interest litigationsystem.The plaintiff qualification, litigation rights, procedures, and relief ways of practiceare emphatically analyzed and expounded.Based on the consideration of subjectqualification, burden of proof, limitation of action, jurisdiction, bear the cost, the plaintiffrewarding,the third part of the thesis proposed the consummation and the construction ofenvironmental public interest litigation system in China ’s legislation.
