Self-guided Tour Organizers Tort Liability

Along with the development of traveling personalization, more and more peoplefavorite self-tourism. However, due to the lack of legal regulation, this travel stylecaused a lot of social problems. In this thesis, author cites three typical travel accidentcases and judgments to analyze the concept of self-tourism and the organizer’s tortliability. On that basis, with reference to existing law, the author put forward a fewlegislative proposes in order to handle disputes appropriately. This paper is divided intothree parts:The first part is an overview on self-tourism. This thesis is introduced the conceptof the self-tourism and organizers.And leads to the legal responsibility of the organizersof independent travel.The second part is the analysis on tort liability of the organizers. Based on analysis,we draw a conclusion that the organizers should take security obligations. But hissafeguard obligation should be reasonable restraint.The third part outlines China’s legal problem about self-tourism in the currentstage. it brings improved advice on legal aspect and rescue system and so forth.
