The Research On Current Situation And Strategies Of Administrative Accountability For Safety Supervision Of Coal Mine

As the world’s largest coal producer and consumer, coal industry is an important basic industry in China, and it plays a important role in the development of national economic. But at the same time, China is a country with frequent occurrence of safety accidents in coal mines, frequent safety accidents in coal mines caused a serious threat to the safety of people’s life and property, as well as the healthy development of national economy.The safety production of coal mine is not only related to the development prospects of coal industry, but also an important task for harmonious society construction. In the grim situation of mine safety, government’s supervisory responsibility has become the focus of attention. Because the vast majority causes of coal mine safety accidents can be attributed to a point:the relevant departments’supervisory responsibility is not in place, resulting in the presence of a large number of illegal mines and illegal mining behaviors. Therefore, implementing administrative accountability in the coal mine safety supervision field has become an inevitable trend. It has important practical significances for improving our safety supervision mechanism of coal mine, strengthening the constraints on the power of coal mine safety supervision, as well as perfecting the team coal mine safety supervision.The time of implementing administrative accountability in China is not so long, so there are too many deficiencies. Through to the analysis of the concrete cases, the course of implementing administrative accountability in China can be divided into three periods, they are the informal accountability period, the early period of institutional construction, as well as the new period of institutional construction. Although we have great progress and promotion in institutional construction and we still have a big gap, compared with the actual demand of administrative accountability practice and the foreign country, for example, the accountability object is not so clear, the division of responsibilities between different levels, between the party and government, and between the leader and deputy leader is not so clear; the accountability subject is single, lack of allogeneic accountability; the accountability mode is limited, the single way of punishment cannot reflect original intention of administrative accountability truly; the accountability timing is unreasonable, lacking of accountability in daily supervision, and the time of accountability often affects the rescue and rehabilitation treatment; the negative effects of accountability appear again and again, it cause adverse effects on the continuity of local policy and the officials’ruling concept; the comeback of the officials who had been accounted is always controversial, and so on. In the immature situation of China’s accountability system and the practice, study and draw lessons from the advanced practice of foreign administrative accountability is good for promoting the level of China’s administrative accountability in coal mine safety supervision field. Based on the analysis of administrative accountability experience in the United States, Britain and Sweden and other countries, this paper puts forward specific ideas for promoting China’s administrative accountability on the ways of clearing administrative accountability elements, transforming discipline after the event into advance prevention, transforming power accountability into institutional accountability, as well as promoting the comeback system of the officials who had been accounted, and hope that through these specific measures to promote the orderly conduct of the safety supervision in coal mine, and realize the long period of stability in coal mine production, then guarantee the national economy’s fast and healthy development, as well as the people’s life and property safety.
