Interpretation Of Copyright In The Digital Environment

The copyright system is closely related to the development of scientific andtechnological progress. The digital era brings a "digitalization–dissemination" of thework mode of transmission, which has had a profound impact on the rights of thecopyright system settings. This new mode brings big challenges on the interpretationand application of Copyright Law. By analyzing the plight of China’s copyrightsystem in face of the "digitalization–dissemination" mode, this article presents theintegration of related copyrights in accordance with "the right of reproduction-theright of communication" mode. Of this writing, the author uses the conceptualanalysis and case analysis.The first part of this paper gives analysis on the features of digital technologyand the communication of works under it. Digital technology includes informationprocessing technology and information delivery technology. In correspondence, thecommunication of works has a "digitalization–dissemination" mode in the digitaltechnology environment.The second part starting from the plight of our copyright system in the digitalenvironment, and discussed separately the right of reproduction and the right ofcommunication. The reproduction right part is divided into two sessions: thepermanent copy and temporary copy. In the communication part, by comparingdescription of information network transmission right, performance rights, theatricalrights and the right to broadcast, the article points out that the rights are described indifferent standards, which lead to the coincidence of rights.The third part of this article proposes to re-build and interpret copyright inaccordance with the "reproduction rights-the right of communication" mode. In thepart of the reproduction right, the article points out the need to adhere to the basic roleand independent status of the right of reproduction in the digital environment. Theimportance of replication is to provide to be long-term preservation of a copy. In the part of dissemination right, this article takes the broad concept of dissemination: First,rental rights and distribution rights are included in the right of communication;Second, on the other part concerning information network transmission right,performance rights, theatrical rights and the right to broadcast, this article proposes tointegrate the rights:1, to unify description of standards, to adopt technology-neutralmeasures to describe the rights;2, to highlight the characteristics of all rights from thedimension of time and space;3, to modify the contents of rights which do not meetthe reality.
