Thanks to the three decades of reform and opening up, the economy of China developed rapidly. But along with the rapid economic development, some negative effects also emerged gradually. In recent years, the eruption of the problems of house demolition was the byproduct of the acceleration of industrialization and urbanization. Expropriation and compensation which related to national stability and security, the people’s lives and work, the economic sustainable, must be resolved in the correct ways. This dissertation discusses on the narrow sense of the house expropriation and compensation. Broadly speaking, the housing expropriation should include both the housing expropriation on state-owned land and collective land. In practice, the house expropriation on the collective land is excluded in the scope of the housing expropriation, but takes the way of land expropriation.This dissertation is divided into six chapters:The first chapter, talk about the housing expropriation of China by case and give a brief introduction to the concept.The second chapter, an overview of the status of China’s housing expropriation and compensation, summed up the problems in legislation and practice, tries to analyze the reason.Chapter Ⅲ, analyze<The Regulation of the Expropriation and Compensation to The House on the State-owned Land>which issued newly and put forward the perfect and improve the bill’s feasibility Suggestions.Chapter Ⅳ, discuss the "public interest" which is the premise of the house expropriation and compensation and give personal advice of the "public interest" defined in the field of housing expropriation and Compensation.Chapter Ⅴ, from the perspective of comparative law, reference, summary extraterritorial on the successful experience of the house expropriation and compensation, and put forward recommendations to improve our house expropriation and the compensation system.Chapter Ⅵ, summary and outlook.
