| Water energy resource is the second largest energy resource in China. It gives support to our energy development which also plays an important role in energy security. Now we do not have special legislation on water energy resource development in China. The development of the legal system of water energy resource development is not perfect. Legislation on this field is still rare. There are only a few academic legal researches in this field. But there are many legal issues need to be resolved in the development of water energy resources.This paper gives a general view on water energy resources development of China, and researches on the existing laws and regulations of water energy resources development, then discussing five aspects of the most important legal issues involved in water energy resources development, such as the management system, overall planning, the utilization rights, approval of projects, water energy resources development and environmental protection. On the basis of the researches of foreign legislative experience, this article points out the inadequate of the current legislation, and provides some appropriate legal suggestions. The innovation of this article lies on the advices about perfect water energy resources laws and regulations, management system, overall planning system, development and utilization rights and environmental protection. |
