Land, as a significant natural resource and social wealth, is the basic conditions for survival and livelihood of farmers. The policies on national land are related to farmers’ rights of subsistence and development. With the development of market economy entered a new stage, the transfer of rural land becomes increasingly the urgent need to optimize the allocation of land resources. Meanwhile, in the process of land transfer, due to policy changes, relative historical issues were also diversified.On based of the investigation and empirical research of Chahar Youyihouqi’s People Court, This article describes the phenomenon of the transfer of rural land contract management right and analyzes it theoretically. Meanwhile, it discusses the legal land issues of Chahar Youyihouqi from the trial of practice, and illustrates inherent causes of in-depth analysis by importing these cases. The article is also summarized the universality of disputes and difficult problems on the land contract and management rights. It also represents some of the recommendations from the legislative, judicial, administrative protection level to explore the land contract management rights transfer of the solution of legal disputes to achieve the legal effects, social effects and political effects in a unified way. Mediation pattern is harmonious way to protect the interests of farmers. The people’s court not only plays an important role in the judicial process, but also fully gives judicial activism to mediation pattern. Hope this dissertation on research of the prevention and resolution of the rural land contract management rights transfer disputes have some positive influences and depth of thinking.
