On The Civilian Implementation Of The Procuratorial Supervision System

In recent years, the problems of court civil judgment or order in enforcement and the implementation of chaos is a very acute problem all over our country, undermining the dignity of the law in degrees and shaking the credibility of the judiciary parties while the judicial authority is seriously challenged to have a direct impact on social stability and harmony. There are many reasons, the most fundamental is that the execution program is lack of effective external oversight mechanisms. As state power, even as a part of the jurisdiction, without supervision, executive power can easily lead to power abused and judicial corruption. How to improve the legislation, and establish the right of supervision of the People’s Procuratorate organs of the Civil Execution, in order to strengthen supervision to ensure the unified and correct implementation of the national law, are problems. Although the legislation of this regulation is not very clear, comunity as a national specialized organs,legal supervision of the People’s Procuratorate from the society.In judicial practice,whether the People’s Procuratorate has the enforcement powers of supervision of the court, has long been a hot issue of debate theory and judicial practitioners. Imperfect supervision of China’s civil execution is an unavoidable fact that, in particular, external supervision, procuratorial supervision legislation is seriously flawed, the People’s Procuratorate on the implementation of activities who carried out procuratorial supervision hsa no legal basis. Not only has the civilian implementation of the supervisory system building in our country a strong necessity, feasibility,but also to ease the difficulties in enforcement, the implementation of chaos problem. This paper described the civilian implementation of the procuratorial supervision system based on comparative research methods, the use of foreign People’s Procuratorate involved in the civilian implementation of the procuratorial supervision system,building the civilian implementation of the Inspection and Supervision of the feasibility and necessary from the perspective of analysis and discussion of the theory and practice, strengthening the internal oversight and establishment the external oversight, to build the ideas and proposals of the civil Execution procuratorial supervision system and to anticipate promoting the construcfion of civilian implementation of the procuratorial supervision system.
