In recent years the number of the students in colleges is growing, according to the latest survey, by2010in ordinary colleges students at school for the number of more than two thousand, more and more students also mean that more and more education work and daily management. However, in practice we often find college students in order to protect their legal rights and sued the Alma mater case, in these cases, the students themselves to the right of receiving education security particularly outstanding. But for all the students’ right of receiving education court cases of infringement of the ruling and no unified approach but yet, this not only can’t guarantee of the university students’ basic rights, in the education field left blank, also harm the development of the cause of education in China. Therefore, the author of the right to education from analysis, to university students’ right to education of the present situation of the infringement to explore, to college students’ right to education to the improvement of the security system these three aspects to summarize research education college students violations. In fact, university students’ right to education whether as a theory of research, or as a practical question discussion, there are many defects and shortcomings. Thus, in this paper the existing research results of the reference and absorption, based on the existing laws and regulations and related cases of research, the methods of comparative analysis and the essence of analysis and value analysis, to extract from the law, education in colleges and universities is that the right of receiving education problem comb analysis, and to guarantee the right to education college students, to understand the relationship between students and university.
