Under the background of the times which constantly emphasize the constructionof " resource saving, environment friendly society", the environmental protectionproblem should arouse our attention. Environment quality is not only related to eachperson’s physical safety, but also have a far-reaching influence to the socialsustainable development, and the harmony and stability of the society.Based on this, the theme of this article is" analysis of environmental crime",discussing the characteristics,the causes and the prevention countermeasures of theenvironmental crime. The legislative concept environmental criminal law is theembodiment of human as the center, this situation is not conducive to the protectionof the ecological environment, so this paper adopt the generalized concept ofenvironmental crime, and analys environmental crime from the criminology angle,emphasizing both the human benefit and the environment benefit, and proposesvarious countermeasures. From comparative analysis based on the research at homeand abroad, summarise my viewpoint or acknowledge the opinions of others.The article analys mainly from the following aspects:The first chapter: an overview of environmental crime. The definition of theconcept of environmental crime is the premise of environmental crime study,comprehensive and accurate understand of the environmental crime need grasping thetrue connotation of environmental crime, The traditional concept of environmentalcrime is the embodiment of human as the center, in order to achieve the changingfrom only protect the traditional benefit of the human to protect both human benefitand environment benefit, the connotation of the concept of environmental crimeshould be more rich. Based on the environment benefit value, this article discuss from the perspective of generalized environmental crime environmental crime. this paperclassify environmental crime in particular ways, and analys the present situation andthe characteristic of environmental crime, forecast the trend of environmental crime.The second chapter: the cause of environmental crime. Environmental crimesincluding idea factors, institutional factors, law enforcement factors and policy factors.Idea factors are as follows: lack of the consciousness of environmental protection andone-sided pursuit of economic interests. Institutional factors including: legal loopholeand lack of punishment of existing law. Law enforcement factors of environmentalcrime: the inadequate supervision and insufficient judicial cooperation. Policy factorare:the local economic development mode is not scientific and the evaluation standardsystem of political achievements is not perfect.The third chapter: prevention countermeasure of environmental crime.Environmental crime prevention measures including legal prevention, socialprevention and policy prevention. Legal prevention includes not only the perfectlegislation, strengthen law enforcement and judicial work also contains. Socialprevention includes increasing the environmental protection propaganda andeducation and perfect the social supervision system.
