Study On The Local Legislation Of The Protection Of Minors

Minors are the hope and future of the nation, it is the shared responsibility of the whole society to safeguard the legal rights and interests of minors and help them to grow up healthily. There is no denying that the protection of minors has attracted more and more attention of the whole county and society. However, it is very depressing on the current protection status of minors, many problems cry for solution. The thesis focuses on the local law of the protection of juveniles in our country, with the hope to give more regard and consideration, which makes it reach farther improvement.There are four chapters in this article:The first one:history evolution of the protection legislation on minors in our country. This chapter main introduce its background, experiment phase, vigorous growth phase and adoption phase. The local protection legislation of minors has a close relation with the national one in our country. With detailed description of the history evolution about protection legislation of minors before thorough study, it can help us to master overall condition of the national protection legislation, which is significant for the further research.The second one:current status of the local protection legislation on minors. This chapter main introduce its basic situation, social evaluation and the conflict within the current status. Although with the advantages of local characteristics, local protection legislation has its drawback and defect. The phenomenon that the legal rights and interests of minor is ignored and infringed happens sometimes, which shows the conflict between the legislation and its current status.The third part:the location of local protection legislation of minors. It tell us what its Guideline is, and what its basic principles are, what its overall thoughts are and lastly what its content is. In my opinion, to work out a more feasible legislation in consistent with local actual situation, it is necessary to straighten legislative guideline, define its principle, change its overall thoughts and perfect its content.The fourth part:a consideration on local protection legislation of minors. It mostly describes some ideas on local protection legislation from my view. Hope that we may constitute feasible law according to the successful experience from foreign countries, and construct a comprehensive protection system for minors, establish an authoritative organization, which will make it play a critical role in protection of minors, and create a favorable environment for the young’s healthy growth.In conclusion, I think, it is exigent to make a local protection law of minors which is of novel conception and content so as to resolve the current conflict between protection legislation and the actual status. It is also urgent to break narrowed local protection legislation of minors and construct a comprehensive protection system to protect the young’s legal rights and interests.
