On The Present Situation And Consummation Of China's Local Legislation

With the submission of running state affairs according to law, new laws and regulations are constituted on a large scale , but there exist the conflict and abuse among the local legislation. Therefore, how to consummate China's local legislation becomes urgent. Local legislation is important constituent part in China's national legislation system, and its legislation procedure and quality will have a direct impact on the function of the whole national legislation system. The study of local legislation will help to consummate China's jurisprudence, to ensure and develop the socialist democracy, and to boost running state affairs according to law. The thesis is divided into five parts.In the first part, the basic idea on dispute and the general idea of local legislation is expatiated according to its definition and characteristics so that the explaining bound of the local legislation is confirmed. The discussion on the characteristics of local legislation makes the definition clearer.The second part introduces the principal part and characteristics of local legislation. The introduction of authorized legislation principal part and its basic right implies the deficiency in the principal part and right on the local legislation.The third part elaborates the basic procedure of local legislation. In this part the legislation procedure as well as its basic approach of local regulations and local laws is introduced briefly.The problems of practical local legislation and the cause are analyzed in the fourth part. All sorts of problems, from formulation to implementation in real life, of local legislation are elaborated, and the causes are analyzed and accounted for.In the fifth part, three aspects of the countermeasure of consummating the local legislation is elaborated from improving quality to consummating procedure. In order to improve the legislation quality, the legislators' diathesis should be improved and the legislators' jurisdiction should be made clearer. The present difficult position of the local legislation cannot be changed entirely despite the practical efforts. The procedure and the standard legislation should be consummated so that the procedure justice on local legislation can be better realized.
