Government Intervention In The Small And Medium-sized Enterprise Loan

SMEs are very important to the economic development of the country,so most countries pay a lot of attention to the development of SMEs.In China, SMEs play a very important role in our country in creating jobs,increasing revenue, promoting technological innovation, promoting exportbusiness and maintaining economic vitality, so China should pay moreattention to the development of SMEs. The financing problem is a universalproblem for the development of SMEs. It’s not realistic to solve thisproblem only with market. Government should take the obligation to helpthe SMEs to survive from this problem. From a macro point of view, thegovernment can take a lot of methods to help SMEs to solve the financialproblem, but in comparison, the policy guarantees is a better way. Since1993, China has begun to establish SMEs Credit Guarantee System. Basedon China’s specific national conditions, the SME credit guarantee systemhas its own feature, there are some problems in the building of legalsystem. So this paper will try to give some advices with the writer’sown opinions.This article is divided into four main parts of the discourse:Chapter1: The overview of policy guarantees. First I’d like to startfrom the concept of policy credit guarantee and SME credit guarantee tomake clear of the meaning of the policy credit guarantee. And then I’dlike to analyze the necessity of policy credit guarantee in compare withdifferent government intervention. Then briefly introduce the relevantlaw system to see how law regulates the policy credit guarantee. Chapter2: The development status of China’s policy credit guaranteesystem. The third part firstly describes the status of China’s SME policyguarantees, including the history, the existed law as well as the specificregulation. Then I’d like to evaluate the credit guarantee legal systemcombined with the specific provisions.Chapter3: Policy credit guarantees’ legal practice of foreigncountries. The second part mainly focuses on the legal regulation of thepolicy credit guarantee legal practice of United States as well as Japan.To see the specific provisions of the credit guarantee system of the twocountries can help us to improve the policy credit guarantee law systemof China.Chapter4: Several advices for the development of policy creditguarantee legal system. To improvement of policy credit guarantee legalsystem, our country should make the specialized legislation as well asthe matching law.
