Real Estate Registration Comparison Between Macao SAR And China Mainland

Since the reform and opening-up in China, the development of urbanization inwhole China has been accelerated,and the real property transaction volume has beenincreased,the real property development has become a focus of socialconcern.Because the real property transactions have been evolved,a lot of peoplestarted to pay their attention to the protection of the rights in real property,then makesour commumity urgently needs a comprehensive real property registration system toadjust a variety of legal relations in the real property transaction process.As a nativeof Macau,I deeply feel the change between before and after the Macao’s return to themotherland.In recent years,in addition to the tourism and the gambling industry,thedemand for real property transaction in Macao are much stronger,which also exposedthe problems from the lack of our real property registration system.So now to improvethe real property registration system is the common pursuit of the Mainland andMacao people.Due to the differences of legal traditions between the Mainland andMacau,study between each of real property registration system,is conducive to thedevelopment of the interregional legal communication.In this thesis, through the analysis of Macao’s and the Mainland’s real propertyregistration system,is hoping to find their advantages and disadvantages,and thengives some advises to improve the real property registration system of these two legal territories.The article is divided into four parts,the first part is the basic theory of the realproperty registration system.In the second part,the author introduces the real propertyregistration system of Macao.Then the third part of the article is focus on themainland real property registration system.And the last part which is also the mostimportant part,is the comparison of Macao and the Mainland real property registrationsystem and concluded and represented the author’s considerations.Finally proposessome suggestion to improve these two systems, and expected for a better achievementfor the Macao’s and the Mainland’s real property registration system.
