The Legal Thought About The Workers’ Work Environment Right

The right of work environment as the basic right, sustains workers’survival and development and creates social value, has received the universal attention all over the world. The practice has proved, providing a safe and healthy, and dignity of decent work environment for workers is helpful to improve the enthusiasm and production efficiency. As a large population of the productive powers, our country has been made good efforts on the worker’ protection of safety and healthy, but at present the relevant law system in our country does not explicitly rule the workers’ work environment right, there is a big gap between the other countries. The related labor law system is not mature, and some of them lack of practical operability, is still the great need to resolve. I pay the high attention on the workers’ work environment and its practical significance, and select the work environment right as the theme of my graduation thesis, set the problem in the background of international trend for consideration, using the history and comparative research methods to analyze the right of the work environment. Expecting to put the protection of the work environment right into practice in our country, and gradually achieve the strategic goal of decent work.This thesis is divided into three parts. The first part includes the first chapter, the second chapter, is mainly to introduce and analyze the related conception of environmental right, this part introduces the historical development of the concept, characteristics, contents, and the relationship between the other related rights, at the same time introduces the theoretical basis of work environment right, especially the goal of decent work puts forward a press on the protection of the right. The second part of the article related to some special problems of the work environment right, I combined with typical problems and phenomenon in the social reality to explain, mainly including the problem that nature working environment and humane working environment is not balanced; the issue sexual harassment for women in the workplace; using the words and deeds oppression infringe the right of work environment. The third part, mainly through the comparison between our country and other countries on the work environment right to put forward the method of construction work in our country, taking use of China’s actual and foreign advanced experience to solve the protection of work environment right in our country.
