Abstract/Summary:
The independence of labor union contains the structure and staff’s independence. The reason why China’s unions lack of independence is that, Labor Union Law for the union is a public corporation, private person requiring contradictions, the Constitution and the law does not provide the rights to strike, members of the threshold is too low to enter the union makes the employer representatives, union funds allocated by the company to pay and the lack of labor union rights and liability provisions rigidity. The main reasons why China’s lack of independence of the labor union are as following:the non-union staff democratic elections, wages paid by enterprises, the lack of legal protection of their rights and Labor union staff, part-time, non-occupational and so on.Foreign experiences to achieve the independence of Labor union organizations are:the private law must be make sure the status of labor union and the right to strike, by limiting employer representatives to join labor union, funds provided directly by the Member to pay to protect the rights of labor union; overseas to achieve the independence of labor union experiences are:the election of labor union should be bottom-up staff, full-time staff salaries paid by the union, the union must have professional staff.China’s enterprises to realize the independence of labor union is that the status of private law, requiring enterprises to labor union, the right to strike, limiting management to join labor union should be made clear. Labor union funds specifically paid directly by the members, make clear labor union duties, strengthen the rights of rigidity. Staff to achieve the independence of our union should be implemented bottom-up democratic elections, provides full-time staff salaries paid by the union. The union workers of their rights should be strictly protected by improving working conditions, in order to achieve unions’ professional work.
