| Labor relation is an important content of social economic relations and harmonious labor relationship is the foundation of harmonious society. Since China takes the policy of reformation and opening, non-public economy has been expending by leaps and bounds and has become an organic part of the socialist market economy. Because of the market economy system and the construction of labor law system is still imperfect, at the same time the power contrast between labor and capital is seriously imbalanced, so the legal rights and interests of workers in non-public enterprises have been infringed frequently. Labor conflict in Non-public Enterprises is become a social problem that can't be ignored to build a harmonious society.As the representation of legal rights and interests of laborers, labor union seems more important in this situation which plays an important supporting role on building a harmonious society. We should full display the functions of labor union in the right-safeguarding and the construction of harmonious labor management. But because of the particularity of labor-capital relations in our non-public enterprises, the labor union of non-public enterprises is different with the ones in private ownership enterprises in the capitalistic country . On the other hand, the labor union of non-public enterprises is also different from the ones in the Publicly-owned enterprises and institutions and has its own peculiarities. According to the Marxist theory of labor unions and the newest theoretical results of chinese marxism, the building of trade unions of Chinese non-public enterprises must keep to the socialist labor unions road with Chinese characteristics. Our current unions legal system is lack of specific law on the unions of non-public enterprises, so that in the process of building the non-public enterprises union it reveals many defects such as it is hard to organize trade unions, union leaders have been put in an awkward position, it is difficult for the unions to carry out their responsibilities of protecting workers'legal rights, they even can't guarantee their own legal rights. Presently, how to protect the unions'own legal rights and how to protect the workers'legal rights to the highest degree in order to alleviate labor and capital contradicts and to form harmonious labor relationship is becoming an important content of speeding-up our economic development and building a harmonious society.In this paper, I investigate many non-public enterprises in Zhejiang and some other provinces. The investigation data analyzes the fact of the building of non-public enterprises'labor union. Based on the Marxist theory of labor unions, the newest theoretical results of chinese marxism and the investigation data ,this paper analyzes the problem exists in our non-public enterprises'labor union from practice and theory, and proposes suggestions on resolving those issues such as insisting on humanism, demonstrating the role of labor unions further, perfecting the legal system of labor unions, strengthening the basic function of labor unions, innovating the mechanisms and the working methods of unions. |
