The Research In Our National People’s Congress And Its Standing Committee’s Rules Of Procedure

It is immature for a meeting to be held irregularly and undemocratic for political decisions not to be based on the form of meeting. The indispensable-discussion democracy can be shown in the process of development of the democratic politics in every country and region across the world. Rules of procedure are the kind of basic norms that ensure democratic discussion and it can improve effectively operation and development of democratic politics on the basis of the guaranteed fairness and efficiency. And "Robert’s Rules of Order" as a set of elaborate design of the arts of democracy, exerting a tremendous influence on the evolution of the rules of procedure, has become the basic rules with which western countries have to comply in different conferences. Meanwhile, its influence on the construction of Chinese democratic politics started to be seen indistinctly. However, in China, there is such a fact that almost scholars are used to improving the democratic arts through grandiose democratic value. The purpose of this dissertation is to change that fact, in view of the concept of value in The Preliminary Civil Rights by Mr. Sun Yat-sen; so that let the grandiose democratic value come true gradually through the technological improvement of detailed rules of democracy. Rules of procedure gives the excellent expression to this kind of democratic arts.The dissertation, at the beginning, introduces the rules of procedure systematically as a whole, and demonstrates and analyses them by hoisting them to the height of procedure value, and recognizes its non-ignorable roles in promoting the operation and development of the democratic politics. Secondarily, to use moderately the rules of procedure of western countries as a source of reference, the dissertation sums up and analyzes the main problems existing in National People’s Congress (NPC) and its Standing Committee in accordance with the rules of procedure. And then it probes furtherly into the deep causes resulting in those problems. Finally, the dissertation aimed at the main problems and causes that exist in our NPC and its Standing Committee’s rules of procedure, taking "Robert Rules of Procedure" as the basic reference, proposes correspondingly that improving our NPC and its Standing Committee’s Rules of Procedure can’t do without technology demands for democracy. This should refine and perfect the rules from the specific session system, public system, speaking mechanism, and the voting system. It should also improve the attendees’respect and grasp to the rules from the height of consciousness, forming the good habit of democracy.
