Teachers’rights have broad and narrow the points, the teacher generalized constitutional rights, including the right to citizenship and engaged in education work as a professional rights. Special teacher right means only teachers’ professional rights. The author in this study selected in the narrow sense of teachers’ rights as research object, by this study is more targeted.With China’s education reform, the perfection of the legal system education, primary and middle school teachers’ construction has made great progress. Our country has formed a large and middle and primary school education teachers team of high quality, supports the world’s largest compulsory education career. Facing such a large-scale primary and secondary school teachers team, our country should be how to safeguard their lawful rights and improve their political status and social status, professional status, how to meet teacher self presence, to promote the further developing intelligence, completes the obligation education stage work, be in education management personnel in the presence of a new problem, this is our country education legal system construction of one of the central task.The lack of primary and middle school teachers’ rights is not only related to the teachers’ self-esteem and safety, more important is because the teacher right to influence the education and lost a quality, the influence of the children’s future.
