Study On Price Hearing System

It is essential to standardize and optimize administrative hearing system in the construction of social democracy and the rule of law. As a system that is closely related to the public, the construction of price hearing system is an important guarantee to improve the transparency, impartiality and democracy of the pricing departments in the process of policy making. At the same time, this system is the supervisory means to prevent administrative organizations from pricing optionally. China has made some achievements in the aspect of system construction and development since administrative hearing system was introduced to China. Along with the promulgation of the Price Law and the implementation of the Measures for the Hearing for Prices Set by Government, the price hearing system steps onto a new stage. However, there are cracks and insufficiencies in the establishment and implementation of the system. Therefore, one of the significant jobs for legal construction is to perfect price hearing system. On this account, this thesis is firstly going to analyze the rationales of price hearing system and the situation of price hearing system development in China, and then reflect the reasons for chaos of price hearing system in our country. As referring to the foreign advanced legal experience, the author puts forward suggestions for optimizing price hearing system.This thesis divides into the preface and the key text. The preface mainly introduces the research background, foreign studies of price hearing system and the research thinking of the thesis. The key text includes four chapters. Chapter one reviews price hearing system by introducing the theoretical basis, the definition and the applied scopes and standards of hearing system. Chapter two is about the development of price hearing system in China, setting forth the legislation of hearing system in China, the background and process of producing price hearing system and the necessities of establishing price hearing system. Chapter three analyzes the chaos of price hearing system through cases, and reflects the reasons. Chapter four visualizes the perfection of price hearing system. According the progressive experience abroad, the author puts forward suggestions from four aspects, namely perfecting the procedures and distribution of price hearing delegate; establishing the legal effects of price hearing records; establishing openness system of price hearing information; optimizing rights system of price hearing. The construction of price hearing system is a long-term and significant process, and the author hopes that the ideas of this thesis can be embodied in the practice.
