Empirical Study About The Miners' Life, The Right To Health Protection

The miners of the vulnerable groups come from the bottom of society during thetransition of our society. They own low level of technology and education. They areexperiencing hard work environment, simple living conditions, low levels of benefits,rights seriously infringed. Most of all their life and health rights which are the most basicones are being threaten. In the construction of China’s socialist rule of law, an importantelement is to promote equality of rights, the protection of human rights, peasant work asan important part of our work force, their rights of equality and the degree of protection bythe law should be widespread concern. As part of the migrant workers, the miners becauseof the particularity in the work, their interests are vulnerable to infringement. The maincontents of this article is through field research of China miners living conditions, workenvironment and the right to life and health status analysis, the safety maintenance ofrights and judicial protection of life and health claims, the miners faced with serious lackof protection, this article by national legislation, internal regulations, the reason of the lackof protection of the miners in their own qualities and social supervision, come to theimperfections of the legal protection in China. Compared to foreign miners the right to lifeand health protection with superior protection mechanisms: competitive wages andbenefits, improve the trade union legislation and a sound system of training and effectivesocial regulation, and thus I propose, analyze the current matter of lack of protection inChina learn from foreign countries effective protection mechanism on the basis ofConstruction in China from the following aspects: from legal to build a morecomprehensive legal system; strict duty of prevention and after the matter is happen theresponsibility in the enterprise, the enterprise harsh and related training and educationsystem to implement its obligations; in the community supervision, the two paralleloversight mechanisms, namely: the establishment of an independent mineral safetysupervision, administration system and a wide range of third party monitoring system;miners building will have to improve worker quality and perfect the mechanisms ofeducation.
