The socialization of execution punishment is a trend of thedevelopment of international execution punishment, and it’s thefundamental way to ease the prison execution paradox, improveexecution performance and transform execution quality. Compared tothe West, the socialization of execution punishment in China started abit late. Therefore, to analyze the current situation of China’sexecution socialization, through drawing on the beneficial foreignlegislative and practical experience to seek and design effectivemeasures and programs, has an obvious significance for promotingthe execution of penal reform in the social-oriented and playing thebest performance of the penal operation.In this paper, comparative study of journal is used to analyze thebasic concept, connotation, characteristics, theoretical basis andvalues of the socialization of execution punishment. Combining ofpractice and experience of the extra-territorial, it also analyzes theproblems faced by China’s execution socialization and finally putforward the legal systems to build the socialization of executionPunishment.In addition to the introduction and conclusion, this paper can bedivided into five chapters:Chapter one is the overview of the socialization of executionpunishment. This section is mainly to define the concept of thesocialization of execution punishment and point out the connotationand characteristics of the socialization of execution punishment. Thefirst part lists the different definitions on the concept of the socialization of execution, analyzes the connotation of socializationof the execution punishment and indicates the characteristics ofsocialization of the execution punishment.Chapter two is the theory of the socialization of executionpunishment. The first part is the legal basis of the socialization ofexecution punishment, including the penalties for humanitarian spirit,the penalty for economic theory, modesty of criminal thinking andeducation punishment theory. In addition, it also analyzes the valuesof democratic value, liberal value and benefit value of thesocialization of execution punishment.Chapter three has analyzed the related legislations and practice inthe outside countries and regions, such as UK, U.S.A, Australia,Japan and other countries and regions. It describes the practice andexperience of these countries and regions in the implementation ofthe socialization of execution punishment for the purpose of ourstudy and learning.Chapter four is the analysis of China’s status quo of thesocialization of execution punishment. The first section is tointroduce China’s implementation of the socialization of executionpunishment and put forward the problems faced in the currentpractices of the socialization of execution punishment, including lowapplicable rate to non-custodial sentence, the concept behind,irrational prison overall layout, scientific deficiencies of educationreform and the implementation of the non-custodial sentence chaos.Chapter five is to put forward some legal systems to build China’sthe socialization of execution punishment, through learning fromforeign practices and experience and combining with China’s specific national conditions. These systems include the classificationtreatment system, community correction system, criminalpsychological treatment system and the released prisons’ protectionsystem.
