In recent years, because a single chemical composition of western medicine cannot meetthe treatment demand for the modern complex disease, the international pharmaceuticalmarket has a rapidly growing demand for natural medicines that contain multiple ingredients.As a gem of Chinese traditional culture, Chinese medicine is facing a god-given opportunityto the world.In order to Chinese medicine can be protected effectively by the patent system in theworld, the thesis mainly uses of the comparative method to explore the differences betweentraditional Chinese medicine and herbal medicine, and from the point of view of the Sino-USpatent law on drugs, the thesis explores of the protection mode of U.S. patent law for herbalmedicine. The purpose of the study point out the problem that the current patent system is notconducive to protect the traditional Chinese medicine, and through the comparative study, putforward some reasonable and effective suggestions for the protection for Chinese medicine.
