Since the reform and opening-up, private higher education of china developsvery fast and have achieved remarkable achievements, in which the teachers are seenas a very important source. theoretically, they are highly valued, but in the real life,their legal rights are not properly met and guaranteed. Teacher’s legal rights in theprivate college are usually subjected to invasion and they have no place to report andcan not be relieved smoothly. the section of maintaining the rights is unreal, therelated organizations lack monitoring, law and policy which are based are so generalas to lack maneuverability. Owing to this kind situation, this paper focuses on thestudy of the guaranteeing teacher’s rights in private college from four perspectives.The first part states the meaning and contents of teacher’s rights in privatecollege from the related concept which are divided into two kinds----basic rights andprofessional rights according to teacher’s status; spiritual rights and material rightsaccording to their attribute.The second part outlines the current situation of protection of teacher’s rightsguaranteeing in private college, analyzes various reasons that cause bad protection ofrights guaranteeing in private college, including backward of idea and consciousness;disfunctional law system; imperfection of social insurance and personnel system; lackof the right monitoring mechanism in inner partof the private college and nominalexistance of the rightsmaintaining organization; serious shortage of financial powerresources.The third part draws lessons from successful experiences of guaranteeing rightsof some American and Japanese private higher education so as to get variousapocalypses of teacher rights guaranteeing in Chinese private colleges.The fourth part puts forward a series of problem-solving counter plans andsuggestions about teacher’s rights in the private college: build up and improve theguaranteeing system of law and rules concerning the teacher’s rights in the privatecollege; build up a series of guaranteeing system of the teacher’s rights in the privatecollege; explore social insurance and business insurance system that suits teacher’scharacteristics in the private college of our country; set up the organizational systemof teacher’s right guaranteeing inside the private college; enhance the initiative ofself-protection of rights of the teachers in private college, strengthen theconsciousness of safeguarding rights and enhance the ability of safeguarding rights.
