Confucian culture is one of the most important core Chinese traditional cultures. It is theideological origins of the Chinese national spirit, involving politics, ethics, culture, religion andphilosophy and so on. The self-cultivation Spirit and cultivate one’s morality to run household to theentire world have a far-reaching impact on Chinese culture. The five Constant Virtues combined withthe spirit of the people, industrious spirit, Cautiousness spirit, integrity of spirit, truth-seeking spiritwhich are regarded as the classic of human ethics and morality, have become a very important part ofChinese culture.In the21st century, China’s Reform and Opening Up police gets remarkable achievements insocialist modernization and emphasizes on the building of a harmonious society at the same time.Government is striving to construct a perfect legal system. However, it is worth noting that the lawconstruction of socialist is facing a deep and long Confucian cultural background which regards Man ofGod as law. Confucian imperial supremacy is contradicted with spirit of socialist law which pursuitsdemocracy. What kind of impact will the Confucian culture give to the construction of law? What isworth of inheriting and carrying forward about Confucian culture in the law construction of socialist?Those problems are unavoidable and deserve more attentions.This thesis is divided into four parts and will discuss closely related to the content of Confucianculture and the law construction of socialist society:The first Part: Introduction: Pose research questions. In this part, author clears the purpose andsignificance of this topic. On the basic of overview Confucian culture’s development and the positiverole played by Confucian culture in social development, author offers a critical point of view to see therelationship between the Confucian culture and the law construction of socialist.The Second Part: The Interpretation of Conceptions. Author takes Confucian culture from theaspect of "Road to politic, Propriety, the people’ moral sense” to interpret the spiritual connotation ofConfucian Culture. Author chooses the basic elements and substance of law to explain the connotationand denotation of law. Author compares similarities and differences in Confucian culture and thesocialist law from the perspective of contemporary political civilization and advanced culture in thestate management and the core social values.The Third Part: Value Proposition. Author combines core spirit of Confucian culture “benevolence,righteousness, propriety, wisdom, loyalty” together with the principle of legal system “legislation, lawenforcement, judicial process, law-abiding, harmonious interpersonal integration” to achieve legislative compliance ceremony abiding by the law, morality and intelligence of Justice. The core connotation likeDiligence, Cautiousness and Integrity, truth-seeking together with legal workforce can make a goodcontribution to the law construction of socialist as cultural supports.The Forth Part: Suggestion. Author offers some principles in the law construction of socialist: toinsist on the supremacy of law in stand of imperial power; to abandon the tradition of social connectionin the enforcement of law and adhere to law principle; to focus on removing the dregs of feudal thinkingand clear a way for the law construction of socialist. To excavated thought essences from ConfucianMorality and Legal, we can close the meeting point of the Confucian Virtue and the socialist law, andalso can further explain the meaning of the combination of virtue and law at this time.
