Research On The Impact Of The Main Idea Of Confucian Culture On The Rule Of Law In Contemporary China

Since law has been generated, law, as a form of the existence of ideological social relations and social consciousness, has been inextricably linked to the history and culture in its times, and underlines the cultural continuity.Confucian culture is an important part of the traditional culture, and even to some extent become synonymous with Chinese traditional culture. The number of the ancient codes and records of it, same to the number of the researchers of it, is so large that it is unmatched by other cultural traditions. Confucian culture, in particular its main idea has become a pervasive consciousness of the Chinese people, deeply in their thought, and embodied in the behaviors.Based on the above, the process of building the rule of iaw in contemporary China, is subject to the impact of the main idea of the Confucian culture all the time, both positive and negative. How to discard the dross and select the essence? All requires us a dialectical thinking and sober analysis. This paper is to study those important issues.This paper is divided into four parts:Firstly, historical retrospect of the Confucian culture; Secondly, the process of contemporary China's rule of law; Thirdly, the impact of the main ideas of Confucianism on the rule of law in China, and the comparative analysis between the legal thinking of Confucian culture and Western Legal Thought; Finally, making full use of the positively sprits of rule of law in Confucianism.Confucian culture as traditional cultural forces, has a solid social foundation, and its main ideas exist and root in the ordinary people's consciousness, psychology, habits, behavior and the process of life, and even to some extent receive widespread public belief and recognition. Based on above, in the process of building the rule of law in our country, the main idea of Confucian culture's influence can not be ignored, because the rule of law in our country must also be a fundamental bottom-up in order to establish a genuine harmonious rule of law in our country.
