On Our Country’s Security Mediation System Applicable And The Perfect

As a policeman of public security organs,I have experienced publicsecurity mediation for many times,and have much deep feeling in it. The paperstarts from the basic theory of public security mediation,namely the meaning,the function,the role and the significance. This mediation is applicable infour public security conditions, Firstly the act is caused by civil disputes;Secondly it must be minor acts violating the administration of publicsecurity; Thirdly the two parties should be voluntary; Finally the publicsecurity organs think it may be mediated and in public security organs underthe auspices of mediation.On this basis, combined with practice of lawenforcement and the Weifang Municipal Public Security Bureau of Weichengbranch,I summarize three big problems in our practice-Applicable scope isinaccurate; Do not attach enough importance to procedure and the work ofinvestigation and evidence collection;The methods should be improved. Thensummarize three big problems in the Public Security Mediation Legislation-fuzzy language, the lack of effective supervision of public security mediation,and ineffectiveness of the public security mediation.And then propose somespecific suggestions, One is to introduce" public intermediation" mechanismto resolve acts violating the administration of public security, The other isrefine the public security mediation preparations, based on the existinglegal system.Last is to perfect the legislation and the mediation system.
