Grassroots Judicial Act And Rule Of Law

At present, China is in the period of social transformation.Grassroots judicial organs directly face the social contradiction, whose judicial action have important and profound influence in resolving social disputes and forming the management thought. However in practice, due to the influence and the restriction from every aspects, the judicial behavior of a judicial organ would sometimes show against the construction of legal constructing requirement. Therefore, in-depth analysis of current basic level judicial behavior problems and exploration of the grassroots judicial behavior are basic problems for legal construction which can not be ignored.The whole paper is divided into three parts.The first part is "Raising the questions"; the second part is "The analysis of the questions"; the third part is "Solving the questions".In short, this article has some innovations in topic selection. Although the existing literature on the authority of law, judicial behavior and the relationship between policy and rule of law have been discussed in many, but combines these together.This paper uses a length of the typical to describe a relevant case in order to vividly revealing the influence and restrict in judicial practice of judicial behavior factors, which makes the argument and discussion have more practical significance.
