China Housing Security System Legislative Studies

In human production and life, housing as one of the basic human survival elements isvery important to our people on the housing, that housing is a necessity for human survival.Chinese Government has been trying to build a multi-level supply system based on marketsupply, around the real estate prices, the civilians cannot afford to purchase the hugeinvestment. That case emerge a large number of homeless people whose housing demandsare very strong. How to reasonable use the government administration in order to protect theright of residence of citizens according to allocate the national resources, that has became ahot topic in academia. The current housing security system is based on a policy and a singleline of legal provisions the absence of some laws and regulations, lack of supervision duringthe execution and lack of transparency in the use of special funds process, they are the reasonsof the housing-construction-quality-trouble, so we need the basic housing security systemeffective legal regulation. In the first part of this article, it shows that the solution of thehousing problems of low-income families is the government accountability, and then throughthe analysis of China’s existing affordable housing security system, raise the lack of theexisting system, and discussing that we should learn from successful foreign mode in order toimprove the solution of China’s basic housing protection should depend upon the legalregulation. In the last part of this article, we make recommendations legislative principle ofthe law on the protection of the basic housing, then a better solution to the housing problemsof low-income groups in cities and towns.
