There are two general categories of housing:commercial housing and public housing. The public housing is mainly targeted at the socially vulnerable group. Due to low-income, the housing needs of this group cannot be satisfied through the market mechanism. Therefore, the public housing provided by the government becomes necessary. This paper is focused on the low-rent housing (LRH), one of the major manifestations of the public housing.The LRH is an effective measure to resolve the housing difficulties of the low-income population, and hence enhances the social fairness and stability. Some developed countries began very early in the attempt to housing security legislation. By implementing special laws, they largely solved the housing difficulties of low-income population. At present, China’s LRH system is in the process of progressive development. Because of the newness of the system, there are many problems. Especially, the legislative level is not high. Therefore, the LRH system is lacking of a strong legal basis. However, this particular problem has been realized, and Housing Security Act was included in the 11th five-year legislative plan of the NPC Standing Committee in November 2008. The internal discussion paper has been completed. This paper attempts to recommend some legal measures to resolve the problems existing in the current LRH system.This article begins with the concept of LRH. By analyzing its characteristics and historical root, the article comes to the conclusion that the housing shortage is inevitable and the LRH is one of important solutions for housing needs of low-income people. Secondly, by analyzing the legal basis of the LRH, the paper draws the conclusion that the LRH plays a very important role in regulating the real estate market, achieving income redistribution, and protecting social equity and security. Thirdly, from the legal perspective and based on the experience of the developed countries, it is found that there are several legal issues concerning the current LRH system, such as guarantee coverage, property ownership, and liability. Finally, the article provides the legal measures to resolve the limitations existing in the current LRH system,.
