Urban and rural system is the basic land management system in our country, under this system, the only legal way to enter the market of the homestead is National land expropriation. But the Government replaced farmers became the maximum beneficiaries in this process; this raised a series of social contradictions. The appearance of the little property houses break this phenomenon; however the houses with little property right are prohibited. Although small property room has been called and kept, it also has a huge number in the market. These are enough to see its theory research value. The essential problem of the houses with little property right is whether the land-use-right for collective construction can be transferred. Due to the limited level, this object defined the range to the homestead.the little property right houses in my object are all in the homestead.Little property rights houses are soaring housing prices, urban-rural dual structure in China, government monopoly and other factors. If the transfer of the little property right houses is severe restricted, this does not favor the intense and save use of the land; If its transfer is allowed,some conflicts will be caused with the current policy in our country. So this article from the system of government regulation, law and regulations to analysis the root of the little property right house in depth. On the basis of this article in the discussion of little property rights houses problems, and to explain the necessity of setting up the transfer regime of land-use-right for homestead, as well as improvement of the circulation system, so as to fundamentally solve the housing problems of property rights. This article is divided into four chapters in total, are summarized as follows:Chapter one:the basic overview of the little property right houses, as well as to give the definition of it, to analyze the living forms, causes in detail.Chapter two:Point out some legal issues raised by the little property right houses, mainly in the transfer of real rights, contract for sale, buyers risk and so on.Chapter three:the theory of the little property right property houses "ban and put", this chapter is mainly from a different perspective to explain the theoretical basis of the little property right houses should be legalized.Chapter four:Talking about the solutions of the presently-existed "the houses with little property right". This chapter mainly discusses the existing processing methods of the little property right houses, as well as how to improve the existing housing land use right.
