The Research On Legal Governance Issue Of Grazing Invasion Behavior In Gannan Tibetan Areas

Implementing the Household Responsibility System in grassland is the basis ofcarrying out Grazing Forbidden Project. It is also a n effective measurement tomotiving farmers and herders’ enthusiasm on protecting, constructing, and using thegrasslands. Since grassland is “the Golden Bowl” for farmers and herders, thehousehold contract responsibility system made a historic transition on grasslandanimal husbandry’s production structure and management mode. From then on,farmers and herders have the right to use and operate grassland.Grazing prohibition, grazing land resting, and grazing rotation are importantmovements and effective approaches of ecological environment protection. They aresome of the basic measures for rehabilitating degraded grassland. In recent years,along with implementing Grazing prohibition, grazing land resting, and grazingrotation policy in Gannan Tibetan Areas, grassland vegetation got restored to a certaindegree, grass output obviously increased and the trend of grassland degradation wasrestrained. However, with the increase of number of populations and number oflivestock breeding, some problems occurred during the implementation of BanningGrazing Policy. These problems caused some behavior of herders’ barnyard invasion,such as Grazing stealing and Grazing grabbing. Therefore, the disputes in GannanPastoral Area Grassland gradually developed from historically livestock bordercrossing and border conflict to some new types like stealing and grabbing Grazing.Nowadays these disputes have become more and more intensified in the high-densitypopulation of Gannan Tibetan Areas. In the meantime, a third party, that is religiousauthority with common laws in Tibetan Area, is intervening in the dispute settlementmechanism. This presents a special and complicated situation to the grassland dispute.Therefore, this study selected Gannan Tibetan Areas as the research environment,where grasslands disputes are more serious and dispute settlement mechanism isspecialized due to barnyard invasion behavior. Based on the understanding of somerelated policy on utilize grasslands in this area, this study interpreted the types ofgrasslands disputes caused during the process of grassland use, and their historicalevolution. This study also analyzed the causes of grasslands disputes and judicialpredicament that existed in its dispute settlement mechanisms. Finally, this study presented some countermeasures and suggestions of comprehensive management indispute resolution.
