Research On Related Legal Problems Of Administrative Compensation In "Returning Grazing-Growing"

"Returning Grazing-Growing" is a strategic project which took by the central government in the background of grassland ecology environment degradation, and the degradation has influent socioeconomic sustainable development of our country. After seven years as the project be first implemented, the project has achieved some ecological and economic results. But its negative effects are also can't ignored. In the areas where the project implemented, the farmers and herdsmen's lives has been influenced. Someone herd on the sneak, and it happens again and again. It is so hard to protect the ecological environment. The reasons of it are various, but the most important of them is the compensation system is not perfect. The project which harms the interests of fanners and herdsmen is implemented for the public interests. Then the loss can't be borne by the farmers and herdsmen themselves, but should be borne by the state. For this reason, the administrative compensation in "Returning Grazing-Growing" project is important for the protection of interests of farmers and herdsmen and the protection of the ecological development outcomes. But our current compensation system has lots of deficiencies, such as the scattered legislation, the unclear scope of compensation, the single and low standard of compensation and the lack of legal procedures of compensation. Therefore for administrative compensation in"Returning Grazing-Growing" project, on the basis of the demonstration of its theory, my paper makes an analysis of the current situation of administrative compensation in "Returning Grazing-Growing" project. Meanwhile, further analyses its existent problem. From the aspects of basic principles, scopes, modes, Program and means of relief, we need improve our thinking on administrative compensation in "Returning Grazing-Growing" project.
